This is a translation for your convenience; the German version is legally binding.

§ 1 Scope and provider

These terms apply to the browser game "Crazy Berlin", its website and its Chrome extension (together "Crazy Berlin"). The provider is Operator: full name (contact details in the imprint).

Users' own terms don't apply. The contract languages are German and English; the German version prevails.

§ 2 The game

Crazy Berlin is a free, non-commercial hobby project. Nothing is for sale: there are no paid features, no credit to buy and no paid advertising.

Crazy Berlin is a multiplayer game in your browser. The game world is built from real map data of Berlin; characters, missions, transport services, weather, police, courts and events in the game are part of the game and don't depict reality.

We keep developing the game and may change content, features and game rules where this is reasonable for you. There is no right to particular features or to uninterrupted availability; maintenance and outages can happen. In particular, multiplayer (seeing other players live, nearby chat) may be switched off for a while or for good — the game then carries on without it.

§ 3 Account, minimum age, guest play

You must be at least 16 to use Crazy Berlin. Sparks (dating) is for adults (18+) only.

You can play as a guest or create an account with a username and password. The contract of use is concluded when you start as a guest or create your account. Guest accounts are deleted after 30 days without activity.

One account per person. Keep your password secret; accounts must not be sold, transferred or shared. Usernames and display names must not impersonate anyone or be offensive.

§ 4 Conduct and content

Our community rules apply. In particular, the following are forbidden: harassment, hate speech, threats, sexual content involving minors, sharing other people's personal data, spam and scams, cheats, bots and exploiting bugs.

You are responsible for content you post (profile text, photo, messages). You grant us the simple, free right to show it within Crazy Berlin for as long as it is stored. We may remove content that breaks the law or these terms.

You can report illegal content with the in-game report function or by e-mail. We review reports promptly and give reasons for decisions that affect you (Art. 16, 17 Digital Services Act).

§ 5 In-game credit

In-game credit ("credit") is a game currency. It is shown in euro amounts but is not money and not e-money. You use it to pay for things in the game, such as tickets, food, clothes, rental bikes and entry fees.

Credit only comes from playing: every account starts with credit; you earn more with missions (the higher your level, the more they pay), a bonus for every new level, daily missions, Pfand and invites. In-game fines are paid from credit; whatever the credit doesn't cover becomes community service in the game.

Invites: you can invite friends with your invite link. An invite counts once, when the invited person has saved their own profile and reached the level shown in the game; both of you then get the credit shown, you up to the monthly limit shown. Each person may have only one account. We may take back credit from invites of made-up or duplicate accounts and block such accounts. There is no claim to invite credit, and the rules may change for future invites. You share your link yourself — only send it to people who want it.

§ 6 Violations and bans

If you break these terms or the community rules, we may — depending on how serious it is — remove content, warn you, restrict features, or suspend accounts temporarily or permanently. We take your legitimate interests into account and tell you the reasons. You can contest a decision by e-mail; we will then review it again.

§ 7 Liability

We are liable without limitation for intent and gross negligence, for injury to life, body or health, under the German Product Liability Act and to the extent of any guarantee we have given.

For slightly negligent breaches of an essential contractual obligation (one whose fulfilment makes the proper performance of the contract possible in the first place and on whose compliance you may regularly rely), liability is limited to the foreseeable damage typical for this kind of contract. Otherwise, liability for slight negligence is excluded.

§ 8 Term and termination

The contract of use runs for an indefinite period. You can end it at any time by deleting your account in your profile. We can terminate it with two weeks' notice, or without notice for good cause (for example serious or repeated violations).

§ 9 Changes to these terms

We'll tell you about changes to these terms in good time beforehand in the game. Changes that significantly affect your rights or obligations only apply if you agree to them.

§ 10 Final provisions

German law applies, excluding the UN Convention on Contracts for the International Sale of Goods. If you are a consumer, mandatory consumer protection rules of the country where you habitually live remain unaffected.

We are neither willing nor obliged to take part in dispute resolution proceedings before a consumer arbitration board.

If any provision is invalid, the rest of the contract remains valid.
